Keeper liability is conditional, not automatic. A charge can also be pursued against an identified driver on a contractual basis, so a Schedule 4 defect does not necessarily prove that nobody is liable.

Evidence to examine before an appeal or defence

1. Signs and terms. Preserve the entrance, tariff, restriction, illumination and any conflicting wording.
2. Parking event. Distinguish parking time from site-entry and site-exit timestamps, queues and circulation.
3. Payment and authority. Keep receipts, app records, permit evidence and any venue or landowner confirmation.
4. Notice compliance. Compare the actual notice with the statutory route rather than relying on a generic internet checklist.

Assessment order

1. Identify the operator and trade association. The notice should indicate the operator route and any further appeal body, such as POPLA or the IAS.
2. Establish the capacity alleged. Distinguish driver, keeper, hirer, company and authorised user rather than using "owner" loosely.
3. Check whether the land is relevant land. Byelaws, statutory control and particular transport land can alter the Schedule 4 analysis.
4. Audit the notice and timing. The applicable conditions differ depending on whether a notice was placed on the vehicle and whether hire arrangements apply.
5. Examine the contract evidence. Signs, entrance terms, tariff information, payment records, grace or consideration periods, ANPR chronology and landowner authority may all matter.
6. Separate appeal from litigation. Operator and trade-body appeals do not replace the need to respond properly to a later letter of claim or court claim.
